- Claim before the General Directorate of Insurance. The DGS is a body dependent on the Ministry of Economy and Finance, which oversees the operation of insurance companies. Therefore, we can resort to this instance to claim coverage for a claim. However, you must bear in mind that this body only enters to assess discrepancies related to the coverage of the policy, and not questions of expert assessment of the damage. - Judicial claim. If, despite all these internal and administrative claims, a satisfactory result is not obtained for the client, the last resort is the court. How much time do I have to claim from an insurer?
La insurance contract law, Article 23, establishes the statute of limitations for the action to claim against an insurer. The law itself differentiates between material damage insurance and personal injury insurance:
- Material damage insurance claim prescription: 2 years from the occurrence of the accident
- Personal injury insurance claim prescription: 5 years from the occurrence of the accident.
