Am I obliged to pay the ransom if I have an accident while hiking?
Hiking is not considered a risky or dangerous activity, so if it is done in the right conditions, there will be no obligation to pay a fee if a rescue is required. However, if it is carried out ignoring the signs or prohibitions, or it is carried out in areas where authorization should have been requested and is not available, the obligation to pay the corresponding fee could be generated.
What are the fees to pay for search, rescue and salvage services in the Canary Islands?
The amount of the fees is variable. It depends on the number of material and human resources that are mobilized, and the duration of the service. Below we show you the rates for each of the mobilized resources:
- €36/Hour, for each member of the Emergency and Rescue Group that has been mobilized
- €2.000/Hour, for each helicopter
- €40/Hour, for each vehicle, except the forward command post vehicle
- €300/Hour, for the mobilization of the advanced command post vehicle
- €300/Hour, for each vessel
The set of mobilized resources will determine the final amount of the rate.
Is there a maximum rate to pay for search, rescue and salvage in the Canary Islands?
The Government of the Canary Islands establishes maximum limits of the rates to be paid according to the number of people benefited:
- 6.000 € , from 1 to 4 people benefited
- 8.000 € , from 5 to 8 people benefited
- 10.000 € , from 9 to 16 people benefited
- 12.000 € , more than 16 people benefited
Who is required to pay the redemption fee?
The person required to pay the fee is the person who needs to be rescued, that is, whoever is the beneficiary of the search and rescue action. He will be obliged regardless of whether he is the one who requests the ransom or a third party requests it. However, if a third party voluntarily requests a ransom for another, not being necessary, the beneficiary of the ransom will not be obliged to pay.
Who pays the rescue for accidents in organized sports and adventure activities in the Canary Islands?
If it is an activity organized by any natural or legal person, it will be obligated to pay the organizerregardless of whether it is for profit or not. In case of impossibility of payment of this, the beneficiary must pay subsidiarily. The current legal regulation (Art. 173.2 Legislative Decree 1/1994, of July 29) establishes that "Passive subjects in concept of substitutes are natural persons, legal entities and the entities referred to in article 35.4 of Law 58/2003, of December 17, General Tax Law, which organize, with or without profit, the recreational or sports activities generating risk or danger that gave rise to the provision of services subject to this rate»
Our interpretation is that it will be up to the discretion of the General Directorate to determine if it is an organized activity or not. That in the case of a group of friends who organize a kick, it is not an organized activity, but when we speak of the case that another figure is the promoter of the activity (club, association, etc.), even if it is non-profit , if it could be considered an organized activity. But we insist, it would be the discretion of the General Directorate of Security and Emergencies who decides.
What sports and adventure activities are considered dangerous?
If the emergency situation is caused by the practice of a dangerous activity, the beneficiary of the ransom will also be affected by the payment.
