The Council of Ministers has recently approved a Bill that reforms the system for assessing damages caused to people in traffic accidents.
This modification aims to adapt the regulations to the current social reality, promoting faster resolution of conflicts, avoiding legal conflicts between those involved.
Regarding the average of the period 2005 to 2011, according to the damages caused in each traffic accident, the corresponding compensations are modified as follows:
Increases in the amount of compensation
- Compensation for death: they are increased by 50% on average
- Compensation for consequences: it increases by 35% on average
Among other aspects, this project includes the reimbursement of health expenses by insurers to public health services and modifies the method of calculating compensation to victims.
The new scale on which the Ministry of Justice is working, It will take into account, when setting the amounts of compensation, not only the income of the victims, but also aspects such as work or the loss of future capacities in minors or students.
The Ministry of Justice anticipates that the Bill will be approved by the Cortes in this legislature. For the associations of victims of traffic accidents, updating the scale is an urgent measure, setting the maximum date for its approval and publication as January 1 of next year.
